Welcome to Trek Curator. These Terms and Conditions govern your booking and use of any trek, tour, or travel service offered by Trek Curator Pvt Ltd ("we," "us," "our"), based in Thamel, Kathmandu, Nepal. By booking a trip with us, you agree to these terms in full.

1. Trip Changes and Cancellations by Trek Curator
We reserve the right to alter an itinerary, or cancel a trip, due to circumstances beyond our control. Where we cancel a trip, you will be offered an alternative date, an alternative trip, or a refund of amounts not already spent on your behalf. We are not liable for additional costs you incur (flights, visas, gear) as a result of a change or cancellation we make.
2. Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters (earthquake, flood, landslide), extreme weather, pandemic or epidemic, war, civil unrest, government action, border or airspace closure, strikes, or infrastructure failure. Where a force majeure event affects your trip, we will work with you in good faith on rescheduling or crediting what can reasonably be recovered, but no cash refund is guaranteed for costs already incurred on your behalf.
3. Assumption of Risk
Trekking, mountaineering, and travel in the Himalayan region carry inherent risks, including but not limited to altitude sickness, difficult and remote terrain, extreme weather, wildlife, and limited access to medical care. By booking with us, you acknowledge these risks and confirm that you are physically fit to undertake the trip you have chosen.
4. Health Declaration and Medical Disclosure
You must disclose any pre-existing medical condition, injury, or disability that could reasonably affect your safety or ability to complete the trip, via our health declaration form prior to departure. We reserve the right to decline a booking, or to remove a traveller from a trip in progress, where a condition poses a genuine safety risk to that traveller or to the group, at our reasonable discretion and where practical medical advice supports that decision.
5. Travel Insurance
Comprehensive travel insurance covering trip cancellation, medical treatment, and emergency evacuation (including helicopter rescue at altitude) is mandatory for all travellers. You must provide proof of insurance before departure. We are not responsible for costs arising from a traveller's failure to obtain adequate insurance. 6. Passports, Visas, and Permits
You are responsible for holding a valid passport, obtaining the correct visa, and meeting entry requirements for Nepal, Tibet, Bhutan, or India as applicable to your trip. We assist with trekking permits included in your package, but we are not liable for denied entry, visa refusal, or permit issues arising from incorrect or incomplete information you provide.
7. Minors and Group Bookings
Travellers under 18 must be accompanied by a parent or legal guardian, who must sign these Terms on the minor's behalf. Where a booking is made by a group leader or agent on behalf of other travellers, that person confirms they have the authority to accept these Terms on behalf of everyone in the group, and each traveller remains individually bound by them.
8. Third-Party Service Providers
Certain services on your trip, domestic flights, helicopter charters, hotels, lodges, and permit-issuing offices, are provided by independent third parties. While we select these providers with reasonable care, we are not liable for their acts, omissions, delays, or service failures beyond that reasonable diligence.
9. Limitation of Liability
Trek Curator, its guides, porters, and staff take all reasonable care to ensure your safety, but we are not liable for injury, illness, death, loss, or damage arising from circumstances outside our reasonable control, including natural hazards, acts of third parties, or a traveller's failure to follow guide instructions.
10. Code of Conduct
We expect all travellers to respect local communities, cultures, and environments, and to follow the reasonable instructions of guides and staff for the safety of the group. We reserve the right to remove a traveller from a trip, without refund, for conduct that endangers themselves or others.
11. Complaints Procedure
If an issue arises during your trip, please raise it with your guide or our office immediately, so we can attempt to resolve it on the spot. Any complaint not resolved during the trip must be submitted to us in writing within 14 days of your return, along with any supporting details.
12. Dispute Resolution
We aim to resolve any dispute directly and in good faith. If a dispute cannot be resolved this way, both parties agree to attempt mediation before pursuing formal legal action.
13. Governing Law
The laws of Nepal govern these Terms. Subject to Section 12, any disputes will be subject to the jurisdiction of the courts of Kathmandu, Nepal.
14. Intellectual Property
All text, photographs, itineraries, and other content on this website are the property of Trek Curator unless otherwise credited, and may not be copied or reproduced without our written permission.
15. Photography and Media
We may photograph or film trips for marketing purposes. If you do not wish to be included, please tell your guide or notify us in writing before departure.
16. Amendments
We may update these Terms from time to time. The version in effect at the time of your booking applies to that booking. Continued use of our website after changes are posted constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found unenforceable by a court, the remaining provisions continue in full force and effect.
